2. The service
worklab offers an AI assistant you can reach on WhatsApp. You can call our WhatsApp business number or send it messages, and, if you give permission, the assistant can call you back. The assistant can answer questions, help with business tasks, take requests and pass them on to our team. The service runs on the WhatsApp Business Platform and uses OpenAI models for speech recognition, language understanding and speech generation.
How we handle personal data is explained in our Privacy Policy, which forms part of these terms.
3. Who can use it
- You must be at least 16 years old, or older if required by the law of your country, and meet WhatsApp’s own age and usage requirements.
- You must use a WhatsApp account and phone number that you are entitled to use.
- If you use the service on behalf of a company, you confirm that you are authorised to accept these terms on its behalf. Where a separate written agreement exists between your company and worklab, that agreement takes precedence.
4. AI disclosure and limitations
- You are talking to an AI. Calls and messages are handled by an artificial intelligence system, not a human, unless we clearly tell you otherwise. We announce this at the start of each call, as required by the EU Artificial Intelligence Act.
- AI can make mistakes. Answers are generated automatically and may be inaccurate, incomplete, out of date or misunderstood, especially on poor connections or in noisy environments. Always check important information before relying on it.
- No professional advice. The assistant does not provide legal, medical, financial, tax or other professional advice. Nothing it says creates a professional-client relationship.
- Commitments need confirmation. Prices, bookings, offers or other commitments mentioned by the assistant are binding on worklab only once confirmed in writing (for example by e-mail or a WhatsApp message from our team) or in a signed agreement.
- Talk to a human. You can ask for a person to follow up at any time at hello@worklab.biz.
5. No emergency services
The service is not an emergency service. It cannot connect you to police, ambulance, fire services or any other emergency service, and it cannot contact anyone on your behalf in an emergency. In an emergency, call 112 (the European emergency number) or your local emergency number.
6. Calls, consent and opting out
- We will only call you on WhatsApp if you called us first or have given us permission through WhatsApp’s call-permission feature or another clear opt-in.
- You can withdraw permission at any time by sending STOP, by revoking call permission in WhatsApp, by blocking our number, or by e-mailing us.
- We do not record call audio by default. We keep text transcripts as described in the Privacy Policy.
- Do not put a third party on a call or include their information without their knowledge and, where required, their consent.
- Standard WhatsApp, mobile data or network charges from your operator may apply; worklab does not control them.
7. Acceptable use
You agree not to use the service to:
- break any law or infringe anyone’s rights, including privacy and intellectual property rights;
- harass, threaten, defame or abuse anyone, including our staff;
- share illegal content, child sexual abuse material, hate speech or content that incites violence;
- impersonate another person, or provide another person’s personal data without a legal right to do so;
- share special categories of personal data, payment card data, passwords or other sensitive data, except where we have expressly asked for it through a secure channel;
- send spam, run automated or bulk calls or messages, or try to overload, test or disrupt the service;
- try to bypass safety measures, extract system prompts, reverse engineer the service, or use it to build a competing product;
- use the output to generate disinformation, deceive people into believing they are speaking with a human, or violate the OpenAI Usage Policies or the WhatsApp Business Policy.
8. Your content and AI output
- Your content stays yours. You keep all rights to what you say and send (“input”). You give us a limited, non-exclusive licence to process your input only to provide, secure and improve the service, as described in the Privacy Policy.
- Output. To the extent permitted by law, we assign to you any rights we may have in the replies generated for you (“output”). Output may be similar to output given to other users and may not be protected by copyright.
- Your responsibility. You are responsible for how you use output, including checking it for accuracy and suitability.
- No training. We do not use your input or output to train AI models.
- Our service. The worklab name, logo, software, prompts and website remain our property or that of our licensors.
9. Fees
Calling and messaging the worklab assistant on WhatsApp is free of charge for end users unless we clearly tell you otherwise before you incur any cost. Paid worklab plans for businesses are governed by a separate order or agreement, which will state the price (including VAT where applicable), payment terms and, for consumers, your right of withdrawal under Directive 2011/83/EU.
10. Third-party services
The service depends on WhatsApp (Meta) and OpenAI. Your use of WhatsApp is also governed by the WhatsApp Terms of Service. We are not responsible for outages, changes or decisions of these third parties, but we will take reasonable steps to keep the service working when they occur.
11. Availability and changes
We aim to keep the service available around the clock but cannot guarantee uninterrupted or error-free operation. We may change, improve or discontinue features, for example when AI models or WhatsApp features change. If a change significantly and negatively affects you, we will tell you in advance where reasonably possible.
12. Liability
- We are fully liable for damage caused intentionally or through gross negligence, for death or personal injury, under the EU Product Liability Directive and national product liability law, and wherever liability cannot be limited by law.
- For slight negligence, we are liable only for breach of essential obligations (obligations that make the service possible and on which you may regularly rely), and then only for foreseeable damage typical for this type of service.
- Otherwise, and to the extent permitted by law, we are not liable for decisions you make based on AI output, for indirect or consequential loss, or for loss of profit, data or business opportunities when you use the service for business purposes.
- Consumers: nothing in these terms limits your statutory rights under the consumer protection law of your country of residence, including your rights where digital content or a digital service is not in conformity with the contract (Directive (EU) 2019/770).
13. Suspension and termination
You may stop using the service at any time, and you may ask us to delete your data as described in the Privacy Policy. We may suspend or block a phone number from the service, in proportion to the situation, if it is used in breach of these terms or the law, or to protect other users, our staff or our systems. Where reasonable, we will explain why and give you the chance to respond.
14. Governing law and disputes
- These terms are governed by the law of the Republic of Lithuania, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
- If you are a consumer, you also benefit from the mandatory provisions of the law of the country where you habitually reside, and you may bring proceedings in the courts of that country (Regulation (EU) No 1215/2012).
- For business users, the courts of the Republic of Lithuania have exclusive jurisdiction.
- Please contact us first so we can try to resolve any issue informally. Consumers may also contact the State Consumer Rights Protection Authority of the Republic of Lithuania (vvtat.lrv.lt) or an out-of-court dispute resolution body in their own country.
15. General
- Changes to these terms. We may update these terms for legal, technical or business reasons. We will publish the new version on this page and, for significant changes, notify you in advance. If you keep using the service after the change takes effect, the new terms apply; if you do not agree, you can stop using the service.
- Severability. If any provision is found invalid, the rest of the terms remain in force, and the invalid provision will be replaced by the applicable statutory provision.
- Assignment. We may transfer our rights and obligations to a successor business, provided your rights are not reduced.
- Language. These terms are provided in English. If we provide a translation and there is a conflict, the English version prevails unless mandatory consumer law says otherwise.
